Estimates & Proposals

All estimates and proposals are based on the conditions observed at the time of inspection. Hidden hazards, unforeseen site conditions, or changes requested by the property owner may require adjustments to the scope of work and pricing.

Unless otherwise stated, proposals are valid for 30 days from the date issued.

Scope of Work

White Elk Forestry will perform only the work specifically described in the approved proposal or estimate.

Any additional work requested after approval must be agreed to in writing before the additional work begins.

Payment Terms

Payment is due according to the payment schedule outlined in your proposal or invoice.

Invoices not paid by the due date may be subject to late fees or interest where permitted by law.

The customer is responsible for any collection costs or reasonable attorney’s fees incurred in recovering unpaid balances.

Site Access

The customer agrees to provide safe and reasonable access to the work area for personnel, equipment, and vehicles.

Delays caused by inaccessible work areas, locked gates, parked vehicles, pets, or other site restrictions may result in additional charges.

Utilities & Property Marking

The customer is responsible for identifying and marking any private utilities, irrigation lines, septic systems, invisible fences, landscaping features, or other underground improvements that are not readily visible.

White Elk Forestry is not responsible for damage to underground improvements that were not disclosed or properly marked before work began.

Weather & Safety

Forestry work is inherently weather dependent.

White Elk Forestry reserves the right to postpone or suspend work whenever weather, fire restrictions, equipment conditions, or safety concerns create an unsafe working environment.

Project schedules may be adjusted accordingly.

Change Orders

Any changes to the original scope of work must be approved in writing by both parties before the additional work is performed.

Verbal requests do not constitute authorization for additional work.

Property Damage

White Elk Forestry takes reasonable precautions to protect surrounding property during operations. However, forestry work involves heavy timber, equipment, and natural terrain.

Minor disturbance to soil, vegetation, or existing forest conditions may occur as part of normal operations.

The customer agrees to remove or protect valuable personal property, decorations, outdoor furniture, vehicles, or other items located within or adjacent to the work area before work begins.

Force Majeure

White Elk Forestry shall not be responsible for delays caused by events beyond its reasonable control, including but not limited to severe weather, wildfire, government restrictions, natural disasters, equipment failures beyond reasonable control, labor shortages, or material shortages.

Warranty

Unless otherwise stated in writing, White Elk Forestry does not guarantee the future health, stability, or survival of any tree retained on the property.

Tree work and wildfire mitigation reduce risk but cannot eliminate all hazards associated with trees, weather events, insects, disease, or wildfire.

Limitation of Liability

White Elk Forestry’s liability for any claim arising from services provided shall not exceed the amount paid by the customer for the specific services giving rise to the claim, except where otherwise required by law.

Governing Law

These Terms & Conditions shall be governed by the laws of the State of Colorado.
